Business operator and scope

These terms and conditions apply to orders placed through the Pinclair online shop.

The operator is Talha Rasitoglu, Schulstraße 20, 78098 Triberg, Germany. Email: info@pinclair.de. Order support: support@pinclair.de.

We deliver digitally to customers in all billing countries available at checkout. The requirements of each product apply independently of this.

Products

Pinclair sells digital products, including digital gift codes, digital access invitations and similar digital services. There is no physical shipment. The product type, scope, duration, requirements, restrictions, delivery method and any country, account, currency or platform conditions are described on the relevant product page.

Independent retailer

Pinclair is not an official partner, operator, distributor or representative of Duolingo, Canva, Blinkist or other named platforms. Brand and platform names are used solely to identify and describe the products.

Customer requirements

Before ordering, check that your account, region, billing currency, payment method, existing subscription and intended use meet the requirements described on the product page. Pinclair does not provide instructions or support for bypassing country, account, payment, subscription, platform or usage restrictions, including VPN, region or billing circumvention.

Formation of the contract

The presentation of products in the shop is an invitation to place an order, rather than a legally binding offer. You can add a product to your cart and review and correct your information before submitting the order. By clicking the checkout button clearly indicating an obligation to pay, you submit a binding offer to enter into a contract.

The automatic order confirmation only acknowledges receipt. The contract is formed when Pinclair expressly accepts your order or supplies the digital product.

Prices and taxes

The shop displays prices for your selected market. The total amount, any applicable taxes and the payment currency displayed in checkout immediately before you place the order are authoritative. A payment provider may use a different settlement currency from the currency initially displayed in the storefront; check the final checkout amount and currency.

Pinclair applies the German small-business exemption under section 19 of the German VAT Act to eligible supplies taxable in Germany. German VAT is not separately charged on those supplies. Taxes applicable to other transactions, where required, are shown in checkout and on the relevant order documents.

No parcel shipping charges apply.

Payment

You pay at Pinclair with PayPal.

Digital delivery

We process orders every day, including weekends and public holidays. Digital delivery takes place no later than 24 hours after successful payment confirmation. Order review is included in this period.

The order confirmation is not the digital delivery. The product is delivered separately by email, invitation, provision of a code or another method described on the product page. If we cannot fulfil an order, we cancel it and refund the amount paid in accordance with applicable law.

Manual review and declined orders

We may review orders before delivery to prevent misuse, mistaken orders, payment risks and orders that do not meet product requirements. We may decline or cancel an order where there are reasonable indications of misuse, fraud, inconsistent information, payment problems, unmet product requirements, or legal or technical obstacles to delivery. Your statutory rights remain unaffected.

Right of withdrawal

The right of withdrawal and its conditions are explained in our withdrawal and refund policy. For digital content not supplied on a tangible medium, the withdrawal right can expire only where the statutory conditions are met, including express consent to early performance, acknowledgement of the resulting loss of the right and the required confirmation on a durable medium.

For digital services, special rules apply to early performance and possible proportionate payment for services already supplied. Complete loss of the withdrawal right occurs only where the statutory conditions are met.

Non-conforming products

Your statutory rights regarding non-conforming digital products remain fully applicable. Contact support if, for example, a code was not delivered, is invalid or was redeemed before delivery; an invitation does not work; the wrong product was supplied; or the product lacks the expressly described characteristics.

Unsuitable usage requirements

Pinclair does not promise that a product will work with an account, region, billing currency, existing subscription, third-party billing arrangement or intended use that fails to meet the requirements described on the product page. This does not apply where the description was incorrect, incomplete or misleading, or where mandatory consumer rights require otherwise.

Platform changes

Third-party platforms may change their terms, prices, features, redemption rules, regions, subscription models or technical processes. Pinclair cannot control those changes. Your statutory rights against Pinclair remain unaffected.

Liability

Pinclair's liability is unlimited for intentional misconduct and gross negligence, injury to life, body or health, liability under the German Product Liability Act, and any other liability that cannot legally be excluded or limited.

For a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable loss typical of the contract, insofar as such a limitation is legally permitted. Essential obligations are those whose performance enables the contract to be properly fulfilled and on whose performance the customer may ordinarily rely. Mandatory consumer protections remain unaffected.

Dispute resolution

We are neither required nor willing to participate in dispute resolution proceedings before a consumer arbitration body. Mandatory information duties remain unaffected.

Contract language and records

Contracts may be concluded in German or English, according to the language used during checkout. Pinclair retains the contract text. Customers receive the order details, these terms, the withdrawal information and other mandatory information in text form where legally required.

Applicable law

German law applies. This choice does not deprive consumers of mandatory protection provided by the law of their habitual residence where that protection applies. Nothing in these terms excludes statutory consumer rights that cannot lawfully be excluded, including applicable consumer guarantees.
